A quick question....and sorry if this has been covered...I haven't been able to keep up with everything on this thread...bad weekend!
Any way...I heard that because it's an independent board Boro have to go with the decision and can't appeal it. Any further action (compensation wise) would have to go through the high court.
Is this the same for Southampton...can they appeal or not if they are kicked out? X

Either party in the case can appeal, and the case is EFL vs. Southampton.... so the EFL or Southampton can appeal, Boro cannot.
 
If they get away with this, including the alleged spying during the league season, does that mean next season, our fans can turn up in Boro shirts and scarves and observe club training where public access is available?
Yeah, we can actually. Unless we are officially doing it on behalf of the club.
The rule is to stop clubs spying, not fans.
Which is sort of a lot of Southampton fans defence. "He was just a kid with a phone. He doesn't even work for Southampton".
 
If it doesn’t go our way I expect Gibson will keep going all the way to the Court of Arbitration for Sport and the EFL would hate that. We might get a bigger compensation pay out from Southampton in that case and maybe the EFL if they are in any way not following their own rules.
 
I don't think they have pleaded guilty to this, more they said they would not contest the charge?

Probably doesn't matter for the panel, EFL but for any follow up legal action, I think it makes quite a difference?
 
We discussed it on here as soon as we saw pic, can’t believe more wasn’t made of it.

At the time some Boro fan flagged it on the Championship reddit group with a zoomed in photo and a big circle highlighting it as potentially a camera lens and mic on a tripod. Southampton fans countered with loads of cobblers "stop zooming in on his c*** you dirty b@stard" "it's just part of the tree" "it's his trousers" etc etc
 
The points and fine scenario doesn't satisfy the fact we shouldn't be disadvantaged for being cheated against - it's easy to feel pessimistic as it's such a big call - but everything points to a delayed final and us being there. The EFL are clearly ready to postpone as they made sure to explicitly highlight the T&C of tickets and said everything else is at fans own risk.

In terms of a pursuing losses we aren't going to pursue the "£200 million" pot. A similar precedence was set when we launched a case against Derby. We were able to recover losses that we may have earned in the play off semi finals but in this instance we'd only realistically be able to pursue possible earnings from the play off final itself not the prize of winning the play off final.
 
Yep. Eyewitness reports too. He was caught red handed and sounds like they chased him into the golf clubhouse where he got changed. They'll have loads of evidence of what equipment he had on him.
No one seems to have mentioned how baggy his trousers were.. they were ridiculously baggy. To the point of being really strange. You work for a football club, you’re off to do some spying.. why would you go for such baggy trousers?

Message board guff.. if changing the date or venue was far fetched then the EFL wouldn’t have said that it was a possibility.

As it stands it’s all up in the air.. the change of date and venue are very much on the table.. which is not good for Southampton.

Even just taking it into consideration and acting like that could be the case.. suggests very strongly that it could be the case.

The only way it isn’t for me is if it is financially more beneficial to us. The playoff final is £3m minimum.. that is off the table imo. We went for £40m from Derby which will no doubt be much more now.. but if that sort of money is put on the table it could be a difficult offer to turn down.

Deal or No Deal? What do you do?

Do you take the guaranteed £3m and a chance for the big money.. or do you take Southampton’s 2nd year parachute payment.. for them to progress to the final which is a gamble in itself. Their penalties could leave them out of contention for promotion next season and the loss of parachute money would severely restrict them in terms of recruitment and retention.

Play off final or £40m?
If Southampton are allowed to advance, we will sue for a 50% chance being taken from us…ie £100m.

If Southampton lose in the final, it’s an existential issue for them
