Parking Ticket

I’ve just received a parking ticket from Parkingeye. I parked in South Shields hospital which I’ve never been to and used what I thought was a disabled bay using my mothers badge. It turns out it was A+E drop off. A couple of friends are saying don’t pay because they can’t enforce it. Should I just pay up and accept I was wrong?

Your friends need to brush up on private parking, many people receive ccjs because they had the same thinking ignoring letters. Its when the letter before claim arrives on the mat things are about to get serious and instead of paying the £60 and lesson learnt you end up with a default win for the parking company and a £300+ bill from the courts or even worse a ccj and destroyed credit rating for 6 years
 
Why not just park where you’re supposed to and save all the hassle?
Always have and always will park in the cottect bays . The station was a genuine mistske.
Sometimes i have overstayed, failed to obtain the free 30 min ticket, returned within the hour to return goods, had no loose change, etc etc
However, in each and every case I have never parked in disabled or parent / toddler spaces, never blocked entrances for delivery, emergency vehicles etc and therefore it couldnt be shown that have I cost that facilty or business. Parking eye etc etc are just bullying scum
They need a proven case for loss of money to that business to have success in court

I'll agree with you these Parking Eye and similar companies are scumbags and employ awful practices.

But they have already had a landmark case that totally dismisses your defence above. It was Parking Eye v Beavis and went ask the way to the supreme court. Massive game changer of a case that benefited tbe car parking enforcement industry.


You've been more lucky than anything. Well done so far amd more power to your elbow but don't rely on it in the future and expect the same results 👍🏻

Ignore your mates. Parking eye always prosecute. Take photos of the parking bays/sinage to make sure designation of spaces is clear and unambiguous . Contact PALS and ask them to liaise with the Trusts own car parking manager. If they are sympathetic they can have influence on the company. If you are in the wrong and can’t offer any decent mitigation suck it up. You will lose

Yeah thanks for that. I am clearly in the wrong, but was a genuine mistake whilst stressed. I just wondered whether they always prosecuted. But yeah, I’ll suck it up and pay. Thanks.
 
If it was marked as A & E drop off and you parked there its a fine. When under stress you will make some mistakes, because you are human. Whats critical to me me is what the space cleraly marked A & E or did it just have diagonal yellow lines.

I once got a fine in London for going into a bus lane @ 9.30pm on a Sunday night. I thought all bus lanes were 7am to 7pm then, for 50 metres this road was 24 hours bus lane and 99% of its length 7 to 7. Only local drivers would know this and someone with hawk eye and night vision. 100's had been done by Hounslow Council. The Council had permision to put in the little length because of temporary roadworks on the A4 - 1/2 a mile away. Those roadworks had ben finished. It ws clearly a money collection activity. It was £60, if I appealed it would be £120 plus costs and more time and stress. I resented paying the £60, but I thought it was over with by paying it and it was.

With it being in a town and hospital I’m not familiar with I just cannot remember. So I guess the best option is to like you just pay up and avoid the stress. Cheers.

The government should be telling parking companies what they can do, and if they don't, stop their access to the DVLA's database. In addition I also believe car registration details are the same as council tax registration details and you should be allowed to opt out of your personal details being sold by a government agency to a 3rd party.

Pretty standard practice at hospitals.
 
A&E drop off bays aren't exactly subtle. And I doubt the ones in South Shields are marked using some kind of indecipherable Sanddancer cryptology.

Just pay the fine. How much is your time worth? You'll just spaff hours and energy and then lose anyway.

I'd just take the hit and pay. I mean you were in the 'wrong' despite the stress of visiting a child. You have already said that you made a mistake. They happen.

I imagine it's better than the longterm stress of them pursuing you. Even if they have no legal right to claim they will continue to send more demanding and strongly worded letters. You'll also see the fine increasing each time.

I'd just pay whilst you are in the reduced time scale.

I have a feeling being a hospital and the nature of where you parked they may legally come after you. It's a bit different to many of these dodgy car parking companies who have are trying to make a quick buck whilst having zero legal rights to extort money from someone.

It's an A&E drop off. I presume it's pretty clearly marked or sign posted? The only way I can see you having a case is if it isn't.

That said its clearly the last thing you need over Xmas and visiting a loved one. You here plenty of horror stories about hospital parking. The majority seem 'harsh' when you consider why people are trying to park in the first place.

Speculating but probably due to the huge amount of abuse that comes with blue badges being used by those who they aren't registered to
