It's not an idiotic ruling and the whole purpose of the court case was to prove they're cakes in order to be exempt from VAT.I worked in the courts for years. In fact if you go into a court room in the UK, you'll see a person sitting in front of the judge, whose job it is to tell the judge when he's being stupid.
They had obviously popped to the toilet when the judge made this howler. Otherwise he would have leaned over and asked the judge, do you have a slice of Jaffa cake? Do you eat it with a fork on a plate? Do you keep them in the biscuit barrell or cake tin. It's a biscuit that contains some cake. You would call a marathon a bag of nuts would you?
